WHAT IS LSSI?
The extraordinary expansion of electronic communication networks, especially the Internet, as well as the incorporation of the latter into economic life and commercial activity, make it necessary to establish an adequate legal framework that generates in the involved actors the necessary trust for the usage of this new medium.
The LSSI-CE (Law 34/2002, of July 11, on Information Society Services and Electronic Commerce) establishes in this regard both for the intermediation services providers, as well as for the companies offering their products and services and for citizens owning a web page, the necessary rules so that the use and enjoyment of this network, as well as the possible economic activity generated around the purchase and sale of all kind of products and services, becomes a positive, safe and reliable experience.
LAW AFFECTATION
This Law affects all companies or individuals owning a website or using electronic mail for commercial purposes, which are required to notify, within one month, the domain in the trade register in which they are registered. If not, penalties may reach €30,000.
Owners of the domains are bound to include a “Legal Notice” tab or button on their website which will be visible, totally public, and always available, and where the following mandatory information will be found only by clicking the tab:
The owners of such websites must comply with the following, indicating:
1. Company data.
2. Services and product prices and its information, indicating whether VAT and other indirect taxes are included or not, whether shipping costs are included or not, even including applicable discounts for purchase volume, etc.
3. Contracting conditions, which must be able to consult after contracting.
4. A simple system for the correction of the given data.
5. Languages in which the contract can be realised.
6. Indicate in the contracting process starting page the total number of steps or pages the customer has to complete before finishing the purchase, for example:
● Desired service selection,
● Service explanation acceptation,
● Payment method selection,
● Order confirmation.
7. Order confirmation either by an automatic e-mail or with acknowledgement of receipt.

INFRACTIONS AND PENALTIES
The LSSI foreseen infractions for the breach of established obligations are classified as minor, serious and very serious, imposing in each case the following penalties:
MINOR: Fine up to 30,000 euros
SERIOUS: Fine from 30,001 to 150,000 euros
VERY SERIOUS: Fine from 150,001 to 600,000 euros
The Law concedes the supervising and control functions thereof to the Ministry of Industry, Tourism and Trade in the General State Administration level, and to the corresponding bodies of the Autonomous Regions in their respective territorial and jurisdictional spheres. In this control function, the mentioned boards may carry out the necessary inspection activities.
Penalty imposition of non-compliance of LSSI-CE provisions will correspond to the board or authority which issued the unfulfilled resolution or to which the inspectors are assigned.
Likewise, the corresponding Autonomous Region's board in charge of consumer goods matters will sanction infractions regarding consumers and users rights and guarantees.
LAW OBLIGATIONS
It is mandatory for the service providers to indicate on their website through easy access:
1. Company name.
2. Contact data: Town, street, number, telephone, e-mail, and any other means of contact.
3. Trade register registration number.
4. Company VAT number.
5. Services and product prices, indicating whether shipping costs, VAT and any other taxes are included.
6. If the offered service requires a title, authorization, etc. those data must be included and also those of the entity or body which is responsible for its supervision.
7. Conduct codes to which, if applicable, the provider is adhered and the way to consult them electronically.
8. If the service is detached from a regulated profession, it will always be mandatory to inform about the Association data, registration number, academic qualification and the European Union in which this was issued.

01. SENDING ADVERTISEMENTS VIA EMAIL (TITLE III LSSI-CE)
The Law does not allow the execution of commercial communications through the use of the Internet or other electronic means without prior consent. In any case, the sending of commercial communications where the identity of the sender is concealed or hidden on behalf of whom the communication is made, or that contravene the provisions of this article, is prohibited. This also applies to communications that encourage recipients to visit Internet pages that violate the provisions of this article, art. 20 LSSI-CE, provided they can be identified as such and the person or company on behalf of whom they are made or advertised.
The sending of advertising or commercial messages via email is allowed to those users who have previously requested or expressly authorized it. The advertiser must identify themselves, as well as the person or company on behalf of whom the messages are made. However, the sending of commercial communications is permitted to those users with whom there is a pre-existing contractual relationship, in which case the provider may send advertising about products or services similar to those contracted by the client.
In any case, the provider must offer the recipient the opportunity to object to the processing of their data for promotional purposes, both at the time of data collection and in each of the commercial communications directed to them. The Law obliges the service providers to enable free and simple procedures so that the recipients can revoke their given consent, as well as to provide accessible information by electronics means about such procedures.
In all forms of communication, when treating, announcing or sending advertising, it must always be clearly identified as such, including at the beginning of the word “ADVERTISING” or its abbreviation “AD”.
When dealing with promotional offers with special discounts, gifts, etc. and even if these are games or contests, the following obligations must be carried out:

This standard does not apply when there already exists a previous contractual relationship, in which case we indeed will be able to send advertising related to the Adaptation to Law 34/2002, of July 11, of Information Society Services and Electronic Commerce products and services contracted.
02. ELECTRONIC CONTRACTING
E-commerce is the collection of all pages that sell their services or products through the Internet, whether or not payment is made by credit card, as it regulates the contracting process, not the payment method.
Requirements for Electronic Signature and Electronic Contract.
Parties must have legal capacity or capacity to contract. This means they must be able to understand the terms of the contract and make binding decisions.
It is essential to obtain the consent of the parties. Signatories must give their affirmative consent to use an electronic contract or electronic signature.

Providers are not obliged to the contents supervision, but they must communicate any infraction in case they detect it, as well as to offer maximum collaboration with the Ministry of Science and Technology.
05. SAFETY OBLIGATIONS
Since 2008, Internet access providers are obliged to inform about technical measures, antivirus programs, filters against viruses, etc. The possible responsibility for the use of Internet for illicit purposes, has obligate also providers to inform about the security measures adopted in their systems, as well as to inform its customers of the treatment’s purpose and the possibility of rejecting it in an easy and free of charge way.
06. CODES OF CONDUCT (Ethical Code for Electronic Commerce and Advertising)
The law anticipates that Public Administrations must promote the development and implementation of codes of conduct and encourage the participation of all interested associations and organizations.
These codes will be fully accessible electronically, and service providers to users must inform them about these codes, how to consult them, and notify them that adherence to a code is voluntary.
An Ethical Code for Electronic Commerce and Advertising can help companies maintain the trust of users and customers, avoid legal issues, and enhance their reputation.
